Terms of Use.
The terms for accessing this website, using its content, and contacting MUSE Security WorX Australia.
01
About these terms
This website is operated by MUSE Security WorX Australia Pty Ltd, ACN 697 559 185, ABN 58 697 559 185 (MUSE, we, us or our), based in Canberra, Australian Capital Territory.
These terms describe the conditions on which we make the public website at musesecworx-au.com, including its www address, and its content available. Please read them before using the website. If you do not agree, please stop using the website and contact us if you need information through another channel.
These are website-use terms only. They do not themselves create an account, subscription, software licence, purchase, professional engagement or obligation to pay.
02
Website information
The website provides general information about MUSE, NPDL26, RDT26 and related capabilities. We aim to keep that information accurate and current, but it may not address your particular environment or requirements. Please contact us to confirm current specifications, availability, compatibility and delivery arrangements before making a procurement or deployment decision.
Website content is not tailored legal, regulatory, security or technical advice. References to legislation, frameworks or standards do not by themselves establish that a particular deployment is compliant, certified or approved by a government or regulator. Suitability and implementation requirements should be assessed for the relevant environment.
This section does not exclude responsibility for misleading statements or any rights that cannot lawfully be excluded.
03
Products and separate agreements
Access to or use of software, demonstrations, evaluations, professional services or technical materials may require a separate written agreement. Scope, pricing, licensing, support, service levels, warranties, data handling and confidentiality arrangements are governed by the applicable agreement, not established by browsing this website or submitting an enquiry.
If these website terms conflict with a separate agreement between you and MUSE, that agreement prevails for its subject matter. These terms do not amend an existing licence, services agreement or non-disclosure agreement.
04
Permitted use and intellectual property
Website content, branding, graphics and other materials are owned by MUSE or their respective owners or licensors. You may view, download and print reasonable extracts for personal use or internal business evaluation, provided you preserve ownership notices, acknowledge the source and do not alter the material in a misleading way.
Except where permitted by law or an applicable licence, you must obtain permission before republishing substantial portions, selling the content, incorporating it into another commercial offering, or using branding in a way that suggests an endorsement or affiliation. Nothing in these terms limits statutory exceptions to copyright or other rights permitted by law.
You may link to publicly available pages if the link is accurate and does not imply endorsement, disguise the source or bypass access controls. No rights to operate, copy or reverse-engineer MUSE software are granted by access to this website.
05
Responsible use and security
Use the website lawfully and without interfering with other users or the security of our systems. In particular, do not:
- Attempt unauthorised access, bypass access controls, or conduct vulnerability testing without our prior written authorisation.
- Introduce malicious code, disrupt services, or use automated access in a way that materially degrades availability.
- Impersonate another person, provide deliberately misleading information, or submit unlawful or infringing material.
- Use the website to obtain or disclose information you are not authorised to access or share.
If you believe you have found a security issue, contact us using the address below with a non-sensitive description. Do not include credentials, exploit code or exposed personal information in an initial email; ask us to arrange a suitable secure channel.
06
Enquiries and confidential information
Only provide information that you are authorised to share. The enquiry form prepares an email in your email application; you must send that email to submit the enquiry. Completing the form alone does not deliver a message or establish an engagement.
Do not send passwords, access tokens, production datasets, classified material, security-sensitive system details or unnecessary personal information through the public enquiry form or ordinary email. Contact us first to arrange an appropriate channel and, where needed, a non-disclosure agreement.
An enquiry does not itself establish an NDA or a commitment to supply products or services. We will handle personal information as described in our Privacy Policy and respect any confidentiality obligations that otherwise apply. You retain ownership of material you send; we may use it to assess and respond to your enquiry, subject to those obligations.
07
Privacy and external websites
Our Privacy Policy explains how personal information is handled and how to raise privacy questions or complaints. These terms do not replace that policy or request blanket consent to unrelated marketing or other processing.
The website may link to external websites for convenience. Unless expressly stated, a link is not an endorsement. External websites have their own terms, privacy practices and security arrangements, which you should consider before using them. We do not control their content or operation.
08
Availability and access
We seek to maintain a useful, accessible website, but do not promise uninterrupted or error-free access. Maintenance, technical faults and circumstances outside our reasonable control may affect availability. Please contact us if you cannot access information you need.
We may take proportionate steps to restrict access where reasonably necessary to address misuse, a security threat or a legal requirement. Where practicable and appropriate, we will explain a restriction and consider requests to restore access. A website restriction does not itself terminate or change a separate customer agreement.
09
Your rights and our responsibility
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy under the Australian Consumer Law, or any other right or liability that cannot lawfully be excluded, restricted or modified. Information about these protections is available in the ACCC's guidance on contracts and consumer rights.
Subject to those protections, we do not give additional warranties about the public website's uninterrupted availability, completeness or suitability for a particular purpose. This does not limit an express commitment in a separate agreement or excuse misleading conduct.
Responsibility for loss or damage arising from use of the website is determined under applicable law. These terms do not require you to indemnify MUSE or waive claims arising from our negligence, fraud or wilful misconduct. Any product or service liability arrangements must be addressed in the relevant agreement, subject to applicable law.
10
Changes to these terms
We may revise these terms to reflect changes to the website, our operations or applicable law. Published revisions will identify their effective date. We will provide reasonable notice of material changes where practicable, including through a notice on the website.
Changes apply prospectively and do not remove accrued rights or retrospectively alter a separate agreement. Where law requires consent or additional notice, we will obtain that consent or provide that notice. Contact us if you need a previous version.
11
Governing law and disputes
These terms are governed by the laws of the Australian Capital Territory and applicable Commonwealth laws. Subject to any mandatory rights you have to bring a claim elsewhere, you and MUSE submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory and courts entitled to hear appeals from them.
Please contact us if you have a concern so we can try to resolve it. This does not prevent you from seeking urgent relief, contacting a regulator or exercising a statutory right. If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent they can operate lawfully.
